38-year-old driver appears in court for killing FRSC marshal

NIGERIA: A 38-YEAR-OLD driver, Lamidi Saka, has been arraigned at the Osogbo Magistrates Court, Osun State for allegedly causing the death of a Federal Road Safety Commission (FRSC) Marshal, Oladunjoye Ariyo.

The accused, among others, is facing a five-count charge on dangerous driving, driving without a valid driver’s licence and causing the death of an FRSC Marshal.
The prosecutor, Mr. Estine Okolo, on Friday told the court that the accused committed the offence on December 19, 2015 on the Osogbo-Ilorin Road.

Okolo said that the accused was asked to stop after a traffic violation, but drove dangerously to avoid arrest and in the process ran into the Marshal who died on the spot.
The prosecutor said that the driver committed the offences while driving a white Toyota Dyna light truck with registration number XG 126 RSH.
According to the prosecutor, the accused was on the highway without a valid driver’s licence.

He stated that when the accused was apprehended, he produced an expired driver’s licence No. LRGOO46BA2 issued on February 23, 2011.
Okolo said that the offences committed contravened Sections 20, 21, 23(1), (2),10 (4), (1),10 (11) and 25 (1) and (2) of the Federal Road Safety Commission Act, 2007.
The accused, however, pleaded not guilty to the charges against him, but the  counsel to the accused, Mr. Samuel Ibiyemi, prayed the court to grant his client bail in the most liberal terms.
The Magistrate, Mr. Olusola Aluko, granted the accused bail in the sum of N100,000 with two
sureties in like sum.

Aluko said that the sureties must provide evidence of tax payment and should also submit two passport-size photographs with an affidavit of means to the court’s registrar.

The magistrate said that one of the sureties must be a relation of the accused while the other must have landed property in Osogbo.
‎The case has been adjourned till May 2 for further hearing.
